Filing Instruments

Requirements for filing instruments:

• Document must be an original
• Document must be notarized with proper acknowledgment
• Document should contain a legal description or in the case of releases and assignments, a Book and Page/Document number reference

Return Mailing

If the document is being mailed back, a self-addressed, stamped envelope is preferred.

Fees

Recording Fees for Chaves County Effective July 1, 2019

Pursuant to 14-8-15 NMSA, a County Clerk shall collect a recording fee of $25.00 for each document filed or recorded by the County Clerk. If a document being filed or recorded contains more than ten entries to the county recording index, the county clerk shall collect an additional fee of twenty-five dollars ($25.00) for each additional block of ten or fewer entries to the county recording index from the document.

Entries

Grantor & Grantee
Every Grantor and Grantee indexed counts as one entry.

Lots and Blocks
Each lot listed in a block will count as one entry. Lots l, 2, 3, Block 7 will be 3 entries. All of Block 8 will be 1 entry,

Sections
All parcels within the same section are 1 entry. S2SE4, NW4, SE4SW4 of Section 6 T1 1N, R30E will be 1 entry. (The only portion indexed will be the first call of each section, “See Record for Additional Legal Description” will be inserted into the notes field.).

Notaries
There will not be an extra charge for additional notaries. 14-8-12.4 NMSA was repealed.

Other References
Book and Page will each count as one entry.

$25.00 (NMSA14-8-16D) regardless of entry count
